Please read these Terms of Use ("Agreement") carefully before using the services offered by Oleksandr Zhuk ("we," "us," or "our"). This Agreement sets forth the legally binding terms and conditions for your use of our Telegram bot service ("Service").

1. Acceptance of Terms

By accessing or using the Service, you agree to comply with and be bound by these Terms of Use and any other rules or guidelines we may implement in connection with the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using this Service, you confirm that you are 16 or older and that all photos you upload are of yourself.

3. Service Description

The Service allows you to create and generate images of your digital twin based on several photos of yourself. You will receive image credits, which are valid for a specified period, allowing you to generate images through the Service. Pricing and details regarding image credits are available on the platform.

4. Content Restrictions

You agree not to use the Service to upload, generate, or distribute content that:

  • Is offensive, illegal, or inappropriate (including but not limited to nudes, pornography, or violence).
  • Depicts minors or violates anyone's rights, including impersonating others without explicit consent.
  • Promotes hate speech, discrimination, or exploitation of any kind.

We reserve the right to manually monitor and remove any content violating these terms. If you violate these rules, we may terminate your access to the Service.

5. DMCA and Copyright

If you believe that any content on the Service violates your intellectual property rights, you may file a Digital Millennium Copyright Act (DMCA) notice. We will take appropriate action, including removing or disabling access to the infringing material.

6. User Ownership & Licensing

You own the images you generate. However, by using the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and distribute the images for providing, maintaining, and improving the Service.

7. Payment and Refunds

Please note that due to high processing costs, no refunds are offered. Our upstream providers charge us for creating your AI twin and generating images. However, this is a one-time fee, and you will not be charged again unless you choose to purchase more credits.

8. Termination of Service

We may terminate or suspend your account if you violate these Terms of Use, including but not limited to uploading prohibited content. Upon termination, you forfeit all rights to use the Service, and no refunds will be issued.

9. Limitation of Liability

In no event shall Oleksandr Zhuk be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service.

10. Right to Modify Terms

We reserve the right to modify these Terms at any time. Continued use of the Service constitutes your acceptance of any changes.

We do not share your personal data with third parties except for service providers like DigitalOcean and replicate.com, which are necessary for delivering the Service. All third parties adhere to GDPR and other applicable data protection laws.

5. User Rights (GDPR Compliance)

Under the General Data Protection Regulation (GDPR), you have the right to:

  • Access your data.
  • Request correction or deletion of your data.
  • Withdraw consent at any time.

6. Content Monitoring

We retain personal data for as long as necessary to provide the services and fulfill the transactions you have requested. Afterward, data is securely destroyed unless required by law.
